Agreement to Terms 

These Terms of Use form a binding agreement between you and MMC Holding International Ltd and its subsidiaries trading as Magical Mushroom Company regarding your access to and use of https://www.magicalmushroom.com and any related media channels or applications. We are registered in England and our registered office is 3rd Floor, 86-90 Paul Street London EC2A 4NE. Our VAT number is 384 5651 66. 

By using the site you confirm that you have read and understood these Terms and that you agree to follow them. If you do not agree you must stop using the site immediately. 

We may update these Terms at any time. Any changes will take effect once the updated version is posted on the site. Your ongoing use of the site means you accept the updated Terms so you should check them regularly. 

The site is not intended for use in any place where access would breach local law. If you choose to access it from outside the United Kingdom you are responsible for complying with your local laws. 

If you are under 18 you must have a parent or guardian’s permission to use the site and they must supervise your use. 

Intellectual Property Rights 

Unless stated otherwise the site and all content on it including code design text images graphics audio and video are owned or licensed by us and protected by UK and international laws. You may view the site and print or download material for personal use only. You must not copy redistribute publish or exploit any content for commercial purposes without our written consent. 

We reserve all rights not expressly granted in these Terms. 

User Representations 

By using the site you confirm that 
you provide accurate and complete information and will keep it up to date

you are not a minor or you have parental permission 
you will not access the site through automated means 
you will not use the site for unlawful purposes 
your use will comply with applicable laws. 

We may suspend or terminate your account if you provide false or incomplete information. 

User Registration 

Some parts of the site may require registration. You must keep your password confidential and you are responsible for all activity under your account. We may refuse or change a username if we believe it is inappropriate. 

Products 

We aim to display product colours and details accurately but cannot guarantee perfect accuracy. Display settings vary. All products are subject to availability and we may change or discontinue products or prices without notice. 

Purchases and Payment 

We accept Visa Mastercard American Express and PayPal. You must provide accurate account and payment details and keep them updated. All prices are in British pounds and may include applicable taxes. 

We may refuse or limit any order including by restricting quantities or declining orders that appear to be placed by dealers or resellers. 

Return Policy 

If you change your mind you may return items within 14 days of receiving them. Items must be unused and in their original packaging. Returns are at your cost. Refunds will be made to your original payment method within 14 days plus up to 5 working days for clearance. 

We recommend using a tracked and signed service. To arrange a return email hello@magicalmushroom.com. 

Prohibited Activities 

You must not use the site for anything other than its intended purpose. Prohibited actions include collecting data without permission creating automated accounts interfering with security impersonating others uploading harmful files or attempting to reverse engineer the site. Misuse may result in termination of access. 

User Generated Contributions 

If you submit content in any form you confirm that you own it or have permission to use it and that it does not breach any rights or laws. You must not submit unlawful harmful misleading or abusive content. Any breach may result in suspension or termination. 

Contribution Licence 

By providing contributions you permit us to store process and use them as described in our Privacy Policy. If you submit feedback you agree that we may use it freely without compensation. 

Reviews 

If the site allows reviews you must only post fair honest feedback based on personal experience. Reviews must not include offensive discriminatory or unlawful content. We may remove reviews at our discretion and accept no liability for them. By posting a review you grant us the right to use and distribute it. 

Submissions 

Any suggestions ideas or similar material you provide become our property. You waive any moral rights in the material and confirm it is original to you. 

Third Party Websites and Content 

The site may contain links to third-party sites or content. We do not control or endorse these and accept no responsibility for their accuracy or content. Any use of third-party sites is at your own risk. 

Site Management 

We may monitor the site remove content restrict access or take legal action if necessary to protect our rights and ensure the site operates properly. 

Privacy Policy 

Our Privacy Policy forms part of these Terms. By using the site you consent to your data being processed in the United Kingdom. 

Term and Termination 

We may deny access to the site without notice for any reason including breach of these Terms. If your account is terminated you may not create another account without our permission. 

Modifications and Interruptions 

We may change or remove site content at any time. We do not guarantee constant availability and are not liable for downtime or interruptions. 

Governing Law 

These Terms are governed by the laws of the United Kingdom. EU consumers retain mandatory protections under their local laws. Claims may be brought in the courts of England or in the courts of your EU country of residence. 

Dispute Resolution 

The parties will attempt to resolve disputes through written negotiation for at least 30 days before starting arbitration. Any unresolved dispute will be referred to a single arbitrator under the rules of the European Court of Arbitration in London. Proceedings will be in English. 

Corrections 

We may correct errors or update information on the site at any time. 

Disclaimer 

The site is provided on an as is basis without warranties of any kind. We do not guarantee accuracy security availability or suitability. You use the site at your own risk. 

Limitations of Liability 

We are not liable for any direct or indirect losses including lost profit data or revenue arising from your use of the site. If liability cannot be excluded it is limited to the amount you have paid to us in the six months before the claim. 

Indemnification 

You agree to indemnify us for any claims or losses arising from your use of the site breach of these Terms or infringement of third-party rights. 

User Data 

We may store and manage data you provide. Although we take routine backups you are responsible for keeping your own copies. We are not liable for loss or corruption of data. 

Electronic Communications Transactions and Signatures 

By using the site you consent to receive communications electronically and agree that electronic signatures and records have the same legal effect as paper originals. 

Miscellaneous 

These Terms form the entire agreement between you and us. If any part is found unlawful the remaining parts continue in force. We may assign our rights and obligations at any time. Nothing in these Terms creates an employment partnership or agency relationship.
